1. General Terms

By placing an order with Ómega Fruit Co., you agree to the Terms of Service outlined below. These terms exist to ensure fairness, transparency, and product integrity—while recognizing the realities of perishable shipping, agricultural products, and courier operations.

If you do not agree with these terms, please do not complete your purchase.


2. Shipping & Delivery

2.1. Estimated Delivery Dates

All delivery dates shown at checkout are estimates provided by the courier.
They are not guaranteed by Ómega Fruit Co. Courier delays—due to weather, volume, operational issues, or other factors—do not qualify an order for an automatic refund.

2.2. Responsibility for Transit Time

Once a package leaves our facility, transit time is managed by the courier.
Ómega Fruit Co. cannot be held responsible for:

  • missed estimated delivery windows

  • courier delays

  • rerouting

  • sorting errors

  • mechanical failures

  • weather-related delays

We always ship using the fastest practical method for your product type.

2.3. Responsibility for Package Receipt

Customers are responsible for being available to receive deliveries, especially for frozen and perishable items.

Ómega Fruit Co. is not responsible for packages left unattended, delivered to a mailbox, left at a door, or stolen after delivery.


3. Frozen & Perishable Products

3.1. Quality Guarantee

Frozen products (berries, purees, juices) are packed using materials that maintain temperature for the typical transit time.

We guarantee the product quality at the time of delivery.
We do not guarantee the product condition beyond the delivery time.

3.2. Inspection on Arrival

Customers must inspect frozen items immediately upon delivery.

For any issue, customers must contact us within 24 hours with:

  • photos of the exterior box

  • photos of the interior packaging

  • photos of the product itself

  • a description of the issue

This documentation is required for any refund or replacement consideration.

3.3. Eligibility for Refund or Replacement

A frozen/perishable item is eligible for refund only if it arrives fully thawed, warm, spoiled, or unsafe to consume, as verified by photos.

If the product arrives:

  • frozen

  • partially frozen

  • cold with ice crystals

  • cold to the touch

It is considered fully acceptable and not eligible for refund.

3.4. Shipping Fees

Shipping fees are non-refundable under all circumstances.
Replacement items, when approved, are shipped at the customer’s expense unless otherwise specified.

3.5. Incorrect Address

If the customer enters an incorrect address:

  • frozen items and plants cannot be refunded

  • reshipment is available at the customer’s expense

  • dried goods and oils may be refunded minus shipping costs


4. Dried Products, Oils & Non-Perishables

4.1. Condition Upon Arrival

Dried products, powders, teas, and oils are not affected by minor transit delays.
These items are not refundable due to delivery timing or courier delays.

4.2. Defective or Damaged Goods

If a dried good or oil arrives damaged, customers must contact us within 48 hours with photos.
Valid issues will be refunded or replaced at our discretion.

4.3. Shipping Fees

Shipping fees are non-refundable.
Replacement shipments require payment of shipping charges.


5. Sea Buckthorn Plants (Bare-Root Shrubs)

5.1. Dormancy & Appearance

Bare-root shrubs are shipped dormant and may not show visible green growth upon arrival. This is normal and expected.

5.2. 1-Year Alive Guarantee

We guarantee plants that show no sign of life for up to 1 year from shipment date, subject to the following conditions:

The customer must have:

  • planted the shrubs within 3 days of receiving them

  • followed standard care instructions (watering, weeding, mulching, fertilization)

  • planted in appropriate climate zones

  • protected shrubs from pests, animals, lawn equipment, and mechanical damage

5.3. Exclusions

We do not replace plants that died due to:

  • drought

  • frost

  • flooding

  • poor soil conditions

  • improper planting

  • neglect

  • mechanical damage

  • planting in excessive heat

  • incorrect pruning or training

5.4. Shipping Fees

Shipping fees are not refundable on plants or replacement plants.

5.5 Propagation

Plants are sold for planting and resale only. Propagation, vegetative reproduction, or use as mother stock is not permitted without prior written authorization.


6. Customer Errors

6.1. Incorrect Address

If the customer entered the wrong address, provided incomplete information, or missed delivery:

  • frozen items and plants cannot be refunded

  • reshipment is possible for dried goods and oils at the customer’s expense

  • replacement shipping fees always apply

6.2. Failed Delivery Attempts

If the courier makes multiple attempts and the box is returned or spoiled:

  • the product is not refundable

  • reshipment requires full repayment (product + shipping)


7. Refunds, Replacements & Claims

7.1. Time Limits

  • Frozen/perishable goods: 24 hours

  • Dried goods, oils: 48 hours

  • Plants: 1 year (conditions apply)

After these periods, the order is considered accepted.

7.2. Required Documentation

Refunds/replacements will only be considered with clear photos showing:

  • packaging

  • product condition

  • lot code (if applicable)

No exceptions.

7.3. Shipping Fees

Shipping fees are non-refundable in all cases.

7.4. Courier Delays

Courier delays do not qualify an order for a full refund.

Refunds apply only to products proven to be spoiled or unusable on arrival.


8. Wholesale Orders

8.1. Deposits

Wholesale orders require a minimum 50% deposit that is non-refundable unless Ómega Fruit Co. cancels the order.

8.2. Final Payment

Final payment must be received before shipment.


9. Weather, Holidays & Uncontrollable Events

Ómega Fruit Co. is not responsible for delays caused by:

  • weather

  • courier volume

  • strikes

  • customs

  • border delays

  • natural disasters

  • supply chain disruptions

These events do not qualify for refunds.


10. Agreement

By completing a purchase, you acknowledge and agree to these Terms of Service.
